Acceptance of Terms
By downloading, installing, or using Hapikuru (the "Service"), you agree to be bound by these Terms of Use ("Terms").
If you do not agree to these Terms, please do not use the Service. These Terms apply between CHIYUU Co., Ltd. ("we," "us," or "our") and you.
About the Service
Hapikuru is an application that lets you create a group with family and the people close to you, and share and record everyday thank-yous.
It provides features such as sending and receiving thank-yous, reactions, reward quests, and looking back on your records. Basic features are available free of charge.
Accounts
Using the Service requires an account created through Google or Apple authentication.
You are responsible for properly managing your account information, and you may not lend or transfer it to a third party.
License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes.
Prohibited Uses
You may not:
(1) use the Service for any unlawful purpose or in violation of applicable laws;
(2) post or act in ways that defame, threaten, or discriminate against other users;
(3) impersonate another person or register false information;
(4) reverse engineer, decompile, disassemble, or attempt to derive the source code of the Service;
(5) copy, modify, distribute, sell, or lease any part of the Service without authorization;
(6) infringe the rights of others through the Service; or
(7) interfere with the normal operation of the Service.
User Content
You are responsible for the thank-you messages, nicknames, profile images, and other content you post ("User Content").
You grant us a license to use User Content to the extent necessary to provide, store, display, and back up the Service.
Thank-yous posted to a group are visible to the members of that group. Thank-yous recorded under "My own" are visible only to you.
We may hide or delete User Content that violates these Terms without prior notice.
Third-Party Services
The Service integrates with the following third-party services: Google Sign-In (subject to Google's Terms of Service), Apple Sign-In (subject to Apple's Terms of Service), Firebase Cloud Messaging (push notifications), Sentry (error monitoring), Google AdMob (ad delivery), and the App Store and Google Play (distribution and payments).
Use of these services is governed by their respective terms of service and privacy policies. We are not responsible for the content or quality of third-party services.
Fees & Payment
The features of the Service are currently available free of charge.
If we offer paid features or plans in the future, payments will be processed through the App Store (Apple Inc.) or Google Play (Google LLC), and pricing, payment terms, auto-renewal, and refunds will be governed by the respective platform's terms and policies.
Intellectual Property
All intellectual property rights in the Service and its content, features, and functionality belong to us or our licensors.
Our trademarks, logos, and service names may not be used without our prior written consent.
Disclaimer of Warranties
The Service is provided on an "AS IS" and "AS AVAILABLE" basis.
We make no warranties, express or implied, regarding the completeness, accuracy, continuity, or fitness for a particular purpose of the Service.
We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
Reward quest completion is only a record inside the app; we are not involved in how rewards are actually fulfilled between members of a group.
Limitation of Liability
To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including, but not limited to, loss of data or loss of profits) arising out of or related to your use of or inability to use the Service.
Violations
If you violate these Terms, we may issue a warning or restrict your access to part or all of the Service.
Service Termination
If we discontinue the Service, we will provide at least 30 days' notice in the app or on our website prior to the termination date.
Account Deletion
If you wish to delete your account, please contact us through the contact page. Your data following account deletion will be handled in accordance with our Privacy Policy.
Governing Law & Jurisdiction
These Terms are governed by and construed in accordance with the laws of Japan. Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
Dispute Resolution
In the event of any dispute arising in connection with these Terms, the parties shall first attempt to resolve the matter through good-faith negotiation. If the dispute cannot be resolved through negotiation, it shall be resolved in the court specified in the Governing Law & Jurisdiction section.
Changes to Terms
We reserve the right to modify these Terms at any time. If we make significant changes, we will update the date at the top of this page and notify you in the app or on our website. Your continued use of the Service after such changes constitutes your acceptance of the revised Terms.
